Terms of Service

Welcome to Arqive. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Arqive Inc ("Arqive," "we," "us," or "our"), a company registered in Spain with offices at Passeig De Gracia 99, Barcelona.

These Terms govern your access to and use of the Arqive eDiscovery platform, including our website, applications, APIs, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

Platform Overview. Arqive provides an AI-powered eDiscovery platform designed for legal professionals. Our Services include document ingestion (supporting formats such as PST, MBOX, PDF), processing, indexing, AI-assisted review, and productions.

Availability. We use commercially reasonable efforts to ensure the Services are available 24 hours a day, 7 days a week, excluding scheduled maintenance. We will endeavor to provide advance notice of any scheduled maintenance that may affect availability.

Free Trial. We may offer a 7-day free trial for specific plans. If you register for a free trial, we will make the applicable Services available to you on a trial basis free of charge until the earlier of (a) the end of the free trial period, or (b) the start date of any paid subscription.

• RegistrationYou must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials.
• Organization ControlIf you are an administrator for an Organization account, you are responsible for the activities of all users within your organization and for managing their access permissions.
• Security ResponsibilitiesYou explicitly agree to notify us immediately of any unauthorized use of your account. We implement robust security measures (including authentication via Clerk and threat protection via Arcjet), but we cannot guarantee security if your credentials are compromised.

Subscription Fees. Services are billed in advance on a subscription basis (monthly or annual). All payments are non-refundable unless otherwise required by law.

Taxes. Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, excluding only United States (federal or state) taxes based on Arqive’s income.

Price Changes. We reserve the right to adjust pricing for our Services or any components thereof in any manner and at any time. Any price changes will take effect following notice to you.

The Services, including our proprietary code, documentation, and design, are protected by copyright, trademark, and other laws of Spain and foreign countries.

Open Source Software. Our Services may include third-party software components subject to open source licenses (e.g., Apache 2.0, MIT). The terms of those licenses apply to the specific components, and nothing in these Terms limits your rights under such licenses.

You agree to use the Services in compliance with all applicable laws, including without limitation data privacy laws (GDPR, CCPA) and export control laws. You represent that you are not located in a country that is subject to a U.S. or E.U. government embargo.

Governing Law. These Terms shall be governed by the laws of Spain, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Barcelona, Spain.

Updates. We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice on the Services.
